U IME NARODA

Kotarski sud u Dvoru na Uni po predsedniku suda Vujičić Nikoli kao predsdniku vjeća te Roksandić Janko potpredsednik suda i zastavniković Ozranu sekretaru suda kao članvima vijeća i Pantelićm Draganu zapisničaru u predu konfiskacije imovine stanovnika mjesta Zrinj a povodom prijave i predloge Kotarskog N.O.V. u Dvoru na Uni na danas 7 Februara 1946 održanoj nejavnoj raspravi.

Presudio j e -

U smislu člana 28 zakona o konfiskaciji a na osnovu podataka iz spisa Kotarskog N.O.u Dvoru na Uni odjel unutrašnjih poslova od 2/11-1946 brojem 362/46 prema kojim podatcima su svi stanovnici mjesta Zrinj za borbu sposobni i vodili borbu protiv N.O.V. a zatim u koliko nisu streljani ubijeni ili poginuli pobjegli su u tokub rata: konfiskuje se celikupna imovina pokretna i nepokretna svih stanovnika mjesta Zrunj. Narodniḫ neprijatelja i to bez obz gdje se takova nalazi imovina.

U koliko bi se naknadno ustanovilo da se pojedina lica od žitelja mje. Zrinj nebi imala smatrati Narodnim neprijateljima postupaće se u pogledu i u smislu ćlana 8 pomenutog zakona t.j. vratiće im se ili naknaditi vrednost oduzete imovine odnosno u smisli ćlana 6 i 29 zakona o konfiskaciji ostavi će im se u koliko je nužno za uždržavanje uže obitelj osudjenog narodnog neprijatelja.

Ova se presuda u smislu pomenutog zakona ima smatrati izvršnom presudam se dostavlja upravi narodnih dobara kod okružnog narodnog odbora Banije u Petriniji, Javnomm tužiocu Okruga Banije u Petriniji, Službenom listu F.N.R.J. u Beogradu, i Naronim novinama u Zagrebu, radi obnarodovanja, zatim Kotarskom Narodnom odboru u Dvoru na Uni, Kostajnica. Sunja, Petrinija, i Gradskom odboru u Sisku, radi objavljenja na uobičajani način putem svih područnih mjesnih odbora, te ovosudnom gruntovnom uredu.

Obrazloženje

Kotaski Naroni odbor u Dvoru na Uni dostavio je ovom suda 2/11-1946 pod brojem 362/46 u smislu ćlana 28 zakona o konfiskaciji, popis nekretne i imovine svih žitelja mjesta Zrinj kao ratnih zločinaca i narodnih neprijatelja koji su u toku rata streljani, ubijeni poginuli ili pobjegli.

U smislu propisa cit.zakona imaju kotarski sudovi izreči presudu o konfiskaciji cijelokupne imovine odnosnih lica kao ratnih zločinaca, bez, obzira gdje se njihova imovine nalazi. 

Iz mjesta Zrinj koje je prema utvrdienju kotarskog Narodnog odbora u Dvoru na Uni u cijelosti I skupno davalo otpor, te se borilo protiv Narodno oslobodilačke-voske pobjegla su sva lica t.j.svi stanovnici-u koliko nisu strijeljani, ubijeni ili pobjegli-te je u pogledu svih stanovnika toga mjesta valjalo donijeti presudu o konfiskaciji.

Obzirom na okolnost da je mesto Zrinj porušeno usled borbi, unistana sva arhiva mjesnih ustanova i vlasti, tako da nema mogućnosti da se utvrdi ni koje su obitelji ni koja lica pojedinačno nalazila u mjesta za vrijeme borbi vodjenih protiv N.O.V. niti Koja su pobjegla., valjalo je izreći skupnu presudu za sve žitelje odnosnog mjesta, a u koliko bi se naknadno us ustanovilo, da pojedina lica od žitelja mjesta Zrinj, nebi imala da se smatraju neprijateljima, postupaće se u pogledu istih shodno u presudi citiranim zakonskim propisima o konfiskaciji.

VERDICT

IN THE NAME OF THE PEOPLE

Kotarski court in Dvoru na Uni according to the president of the court Nikola Vujičić as the president of the panel and Roksandić Janko the vice president of the court and Zastavniković Ozran the secretary of the court as members of the council and Dragan Pantelić the recorder in the case of the confiscation of the property of the inhabitants of the town of Zrinj on the basis of the application and proposal of the Kotarski N.O.V. in Dvor na Uni at today's 7 February 1946 private hearing.

In terms of Article 28 of the law on confiscation and based on the data from the files of the Kotarski N.O. in the Court of Dvor na Uni, Department of Internal Affairs from 2/11-1946 number 362/46 according to which data all the inhabitants of the town of Zrinj are of fighting ability and led the fight against the N.O.V. and then as long as they were not shot, killed or died in the duration of the war: the total immovable and movable property is confiscated from all residents of the town of Zrinj, the people’s enemies regardless of where such property is located.

In the event that it would later be established that individual persons from the inhabitants of Zrinj should not be considered enemies of the people, they will be dealt with in terms of Article 8 of the aforementioned law, i.e. the property will be returned or they will be compensated for the value of the confiscated property, or in the sense of Articles 6 and 29 of the law on confiscation, they will be left with as much as is necessary for the support of the immediate family of the convicted public enemy.

In the sense of the aforementioned law, this judgment is to be considered an executive judgment, it is delivered to the administration of national assets at the district people's committee of Bania in Petrinja, to the public prosecutor of the district of Bania in Petrinja, to the official gazette F.N.R.J. in Belgrade, and Narone novine in Zagreb, for the purpose of nationalization, then to the District People's Committee in Dvor na Uni, Kostajnica. Sunja, Petrinja, and the City Committee and Sisak, for publication in the usual way through all regional local committees, and this court's ground office.

Explanations

Kotaski Naroni (The regional people’s) committee in Dvor na Uni submitted to this court on 2/11-1946 under number 362/46 in the sense of Article 28 of the law on confiscation, a list of real estate and property of all residents of Zrinj as war criminals and enemies of the people who were shot during the war, killed, accidentally died or escaped.

In terms of the provisions of the aforementioned law, the district courts have the right to pronounce judgments on the confiscation of the entire property of the persons identified as war criminals, regardless of where their property is located.

From the town of Zrinj, which, according to the determination of the district People's Committee in Dvor na Uni, resisted in its entirety and collectively fought against the People's Liberation Army all persons fled, i.e. all citizens, as long as they were not shot, killed or fled,  with respect to all the inhabitants of that place, it was necessary to pass a verdict of confiscation.

Considering the circumstance that the town of Zrinj was destroyed as a result of the fighting, all the archives of local institutions and authorities were destroyed, so that we have no possibility to determine which families or which individuals were in the town during the fighting against N.O.V. nor who escaped., it was appropriate to pronounce a collective verdict for all the inhabitants of the respective place, and if it were subsequently established that individual persons from the inhabitants of the place Zrinj would not have to be considered enemies, they will be dealt with in accordance with the legal regulations cited in the judgment on confiscation.
